Being found inadmissible doesn’t have to end your case. In Immigration Court, properly chosen waivers can transform a losing posture into a grant of relief—but only if you meet the legal standard and win the judge’s discretionary trust.

Common Waivers in Court

  • I-601 / I-601A (Unlawful Presence & More): Cure the 3/10-year bars and certain grounds (e.g., misrepresentation via 212(i) or some crimes via 212(h)) by proving extreme hardship to a qualifying U.S. citizen or LPR spouse or parent.
  • 212(h) (Certain Crimes): Forgives some CIMTs and a single offense of simple possession of 30g or less of marijuana, subject to rehabilitation and equities.
  • 212(i) (Fraud/Misrepresentation): Requires extreme hardship to a qualifying relative and credible, remorseful explanations.
  • 237(a)(1)(H) (Fraud Waiver for LPRs): A powerful waiver that can save permanent residence when the original admission was tainted by fraud or misrepresentation.
  • 212(d)(3) (Nonimmigrant Waiver): Temporary entry despite many inadmissibility grounds; sometimes paired with PD or post-removal options.
  • Legacy 212(c): Limited but still available for certain long-time LPRs with pre-IIRIRA convictions.

How Judges Decide
You carry the burden of proof: first to qualify for the waiver, then to merit a favorable exercise of discretion. Judges weigh positive equities (family ties, work history, rehabilitation, community service, length of residence) against negative factors (seriousness and recency of violations, repeated misconduct).

Evidence that Wins

  • Detailed hardship declarations, medical and psychological reports, country-conditions evidence.
  • Financial analyses showing loss of income, care burdens, or treatment unavailability abroad.
  • Rehabilitation proof: certificates, counseling, clean record, employer and community letters.
  • Consistency across I-130/I-485, applications, and testimony.

Strategy in Removal Proceedings
Coordinate waivers with the underlying relief (adjustment, cancellation, or consular processing after termination). Calendar biometrics, respond to RFEs/NOIDs, and preserve appellate issues. Consider prosecutorial discretion to narrow issues or pause proceedings while USCIS adjudicates a provisional waiver.
