Scialabba Memo Regarding Inadmissibility due to HIV Infection

A September 15, 2009, memo from Lori Scialabba and Donald Neufeld directs USCIS officers. This applies if the only ground of inadmissibility is that the applicant has been diagnosed with HIV infection.

The Scialabba Memo, issued in September 2009, marked a pivotal shift in U.S. immigration policy. It directed USCIS officers to hold in abeyance any applications that would have been denied solely due to an HIV diagnosis.

This guidance anticipated the final rule that officially removed HIV from the list of “communicable diseases of public health significance.”
