— What the guidance says and what to expect at POEs

On November 1, 2021 (guidance updated Jan. 30, 2025), U.S. Customs and Border Protection issued operational guidance for how ports of entry should manage undocumented noncitizens who present at Southwest Border land POEs. The memo explains processing expectations, including parole, expedited removal, credible-fear screening, and use of advance-information systems where implemented. 

Key steps at a POE

  • Primary screening: officers inspect documents and determine admissibility or referral to enforcement processing. 
  • Parole: discretionary release in limited humanitarian or operational circumstances. 
  • Expedited removal & credible-fear: inadmissible individuals may face expedited removal; anyone expressing fear of return must receive credible-fear screening.
  • CBP One / advance info: appointment/advance-info pilots exist at certain POEs to streamline processing, with known operational considerations.

Advocates should instruct clients to ask for admission and request a credible-fear interview if they fear persecution; preserve any written notices or receipts and contact counsel immediately if placed into expedited removal.
