The Biden administration will appeal court’s ruling by a federal judge that temporarily halted lifting Title 42. Last week,
U.S. District Court Judge Robert Summerhays stopped the administration from lifting Title 42 as planned on May 23. The judge granted a preliminary injunction to a group of Republican state attorneys general who opposed ending Title 42. Summerhays argued that the administration bypassed a process that would allow for input from the public on the decision to rescind Title 42. White House press secretary Karine Jean-Pierre argued that the authority to determine a public health policy should reside with the CDC.
