Approved AOS and Fraud. In Nov 2017, we filed AOS and Fraud waiver applications. In 2018, USCIS approved the AOS application and I-601 is still showing pending. We received the FOIA file in October 2023 from the USCIS. In the file, we found that USCIS approved the I-601, Fraud Waiver in 2018. USCIS website is still showing it in process, mostly there is a mistake from USCIS end as they approved the I-601 and forgot to forward it to the next USCIS officer for further processing. There are grave consequences for fraud or willful misrepresentation of facts with the intention of procuring an immigration benefit. The perpetrator will be inadmissible to the United States, which is often severe because it attaches to them for life. The passage of time cannot remove the certain grounds for inadmissibility for fraud or willful misrepresentation, which makes it very severe. Meanwhile, a person can be rendered inadmissible for fraud or misrepresentation of a material fact without understanding why immediately. Sometimes, though not very often, affected applicants can make a waiver request for inadmissibility stemming from misrepresentation or fraud of material fact.
